Terms and Conditions

 

These are the terms and conditions that all online sales are subject. JCO Sports – The Golf Locker TV (“the company”) reserves the right to change these conditions without notice. Any such changes will be listed on this website. By using this website the customer (you) agrees to be bound to these Terms and Conditions.

1. Price

The price shown in the “shopping basket” is quoted in pounds sterling and does not include delivery charges. All prices are inclusive of VAT.

Such delivery charges, if any, shall be listed in the final payment screen, however these charges will be clearly listed in the product description of each item.

The company does not price match against competitors, so the price you see is the price you pay. However, we do competitively price our products.

In the highly unlikely event that the price is incorrect due to an admin error, then the company reserves the right to correct the price, and shall notify you via the contact details that you have left. If you wish to proceed with the order still, then you will be subject to pay the remaining balance of the new price. However, if you do not want to complete the purchase, then we will be happy to give you a refund, via the method of payment that was used originally, or via a discount code that has no expiry date.

2. Ordering of Goods

At the present moment, the company can only accept debit/credit card details and deliver from and to the UK. Deliveries are subject to postal code restrictions. If you believe that you live in a restricted postal code area, then please phone us on 0871 7898458, and we will endeavour to find a courier to post the goods out to you.

The website is fully automated, so stock levels will change with real time. If an item is in stock, then the website will let you purchase the product(s). It will clearly state if an item is not in stock.

2.1 The ordering process

On the website, select the product(s) that you wish to buy. These will then be listed in the basked at the top right hand side of the page.

When you have finished shopping, then you click on “checkout” and it will show the price that you have to pay including delivery.

This is the price that you will be charged via your payment method and this price is final.

3. Payment

The company will accept payment via the following methods.Visa, Visa Electron, Visa Delta, Mastercard, Maestro, Solo, Bank Transfer, Paypal, Hipay and a personal Cheque.In regards to the debit and credit cards, the payment will be authorised by a company called PayPal. We will not release the goods until the company has received data from PayPal that states that the payment has been accepted. If the payment method is declined then we are not liable for any delay in delivery or releasing the goods.

Once the payment has been authorised then this is final. We can’t reverse this process. The goods will be delivered to your designated address and they are your property.

This way of payment is secure as any on the internet, however, no payment over the internet can be 100% secure. We recommend that you have a firewall and virus software on your pc as the company cannot accept any liability to any loss of money due to fraud.

If you believe that your card has been used without your authorisation, then please immediately contact your local bank, building society or credit lender.

We will also accept a personal cheque; however we can’t accept these online. You will have to phone our head office on 0871 7898458. The company will not realise the goods until the cheque has cleared into the company bank account.

If you have a discount code, please enter this where stated on the “checkout” and this will deduct the amount from the total price.

4. Delivery

We are proud to announce that JCO Sports offers competitive rates for delivery.

Orders are charged a standard rate of £4.95 to UK and Ireland. You will receive your order within 2-7days working. We do not post on a weekend.

We will send your order via DHL, UPS, Fastway Couriers or Royal Mail. This will depend on the size and weight of your parcel. A confirmation email will then be sent indicating that your parcel has been dispatched. If you have a tracking number, you may track your parcel here:

1. Free delivery is NOT available to the following postcodes: AB12, AB31-AB56, All BT, DD9, FK20, G83, All GY, HS1-HS69, All IM, IV1-IV63, All JE, KA27 & KA28, KW1-KW17, PA21-PA77, PH19-PH50, All TD9 and ZE1-ZE9 and will be charged at £19.95. Please contact us to confirm
We take care to package your parcel so it stays in pristine condition.

We kindly ask you to check your parcel over before signing for it. If you feel that your parcel has been “tampered” with, then please do not accept. Please contact us immediately on 0871 7898458. We will then contact the courier on your behalf.

Delivery will only be to UK mainland addresses. Deliveries on average will normally be made within 5 business days (excluding Saturday and Sunday).

The company will not accept liability if the goods are not delivered on time due to the following external factors:

1. Environmental Factors – e.g. Bad Weather.
2. Terrorism.
3. Union Strikes.

 

All deliveries are insured for the cost price that the company pays for the goods. So if the goods are lost in transit or are damaged, we will send you a new or similar set out, subject to stock.

All delivery charges are final and are subject to change due to fluctuations in the market.

5. Refunds / Returns
The company are more than happy to accept returns of products if they meet our conditions.

5.1 They are returned with the receipt/invoice within 14days of delivery date.
5.2 They are returned unused or unopened in original packaging.
5.3 They are used but are in manufacturers guarantee with a fault, accompanied by invoice/receipt.
5.4 You MUST inform us via phone on 0871 7898458 or log into you’re my account seciont on jcosports.com and use the email and password you registered with to log in, if you wish to return a product. You must state the problem with the product and our decision will be final if the product has a genuine fault or not, or has been misused.
5.5 We will not accept a return or give a refund on a product if the packaging is lost or damaged, unless it is has a genuine manufacturing fault, in which our decision is final.
5.6 It is your duty to return the product and to make sure that it is returned to us safely. The customer must pay for the courier charge.
5.7 Refund will only be giving to original payment method or via an online voucher after condition 5.1
5.8 Any items returned outside of 28 days will be subject to conditions 5.1 – 5.7 and the company will only be able to offer a voucher code for the total amount minus postage.

If the product is faulty, we will return a new or similar product with your authorisation, free of cost, or give a full refund. The refund will be for the price that you paid on the payment method that you originally used as stated in 5.7. If this is not possible, all we can offer is a voucher code off your next purchase.

This will be done in accordance with the consumer protection legislation.

6. Limitation of Liability.

6.1 We exclude all liability for any loss, damage or expense howsoever suffered or incurred by You as the direct or indirect result of the Goods either not being of satisfactory or merchantable quality, or fit for any purpose, or conforming to any description and You hereby irrevocably waive all rights and/or remedies (if any) which You may have or have had in respect of such loss, damage or expense and/or in respect of any breach or default of any warranty implied by statute, equity or common law concerning the quality, fitness or description of the Goods. We shall not be liable for incidental or consequential damages for any breach hereof.

6.2 You deal as a consumer to the extent that such exclusions or limitations are not permitted by law.

6.3 Nothing in these Conditions shall limit our liability in respect of death or personal injury caused by our own negligence.

7. Miscellaneous

7.1 If any provision of this Agreement is held by any competent authority to be invalid or unenforceable in whole or part the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected.
7.2 We shall not be liable to You for any delay or failure to perform any of Our obligations hereunder which is due to causes or circumstances beyond Our reasonable control, including (without limitation) acts of civil or military authority, national emergencies, fire or flood, strikes, lock-outs and other industrial disputes, acts of God, war or riots, actions or omissions of third parties.
7.3 This Agreement including the order is the complete and exclusive statement of the contractual relationship between the parties, which supersedes all prior proposals, understandings, agreements, or representations between the parties relating to this Agreement except in respect of any fraudulent misrepresentation made by either party.
7.4 We reserve the right to randomly monitor and record our inbound and outbound calls.
7.5 No delay, neglect or forbearance on our part in enforcing its rights against You shall be construed as a waiver or in any way prejudice any of Our rights hereunder.
7.6 Except for Our affiliates, directors, employees or representatives, a person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
7.7 This Agreement shall be governed by and construed in accordance with the laws of England and Wales whose courts shall have non-exclusive jurisdiction in connection with any dispute arising out of or in connection with it and to which jurisdiction You irrevocably submit.
7.8 Abuse towards staff of the company will simply not be tolerated and we will inform relevant third parties if we feel necessary.

8. Agreement

You, the customer, agree that you have read and fully understood the Terms and Conditions. These conditions are final and you agree that if any situation does however arise from these conditions that you must fully comply and bound to them.
We will never release your personal details to any 3rd parties, with the exception of you name and address to the courier so they can deliver your goods.

This does not affect your statutory rights.
